Aptec wins court case

Regional distribution giant Aptec has emerged victorious after a protracted legal battle with Protech Contracting, the parent company of Dubai-based reseller PC International, over an outstanding debt.

Regional distribution giant Aptec has emerged victorious after a protracted legal battle with Protech Contracting, the parent company of Dubai-based reseller PC International, over an outstanding debt.

After several hearings at different levels of the Dubai legal system, the Dubai Court of Cassation upheld an earlier verdict issued by the Court of Appeal, instructing PC International to pay Dhs287,378 (US$78,245) to Aptec plus 5% annual interest on the amount owed for the period that the debt was outstanding.

Aptec issued the following statement relating to the verdict: “Aptec is satisfied with the decision of the Court of Cassation. Aptec strives to serve its customers needs by operating on a fair and equitable basis. All reasonable attempts are made by Aptec to avoid escalation between Aptec and its customers. Where a solution can not be sought, Aptec is confident that its systems and procedures will ensure justice prevails.”

The case centred on PC International’s non-payment of money owed for the purchase of IT equipment from Aptec. The legal dispute started off in the lower courts, which assigned an expert to the case who concluded that Aptec was entitled to receive the outstanding amount.

Protech Contracting appealed against the lower courts’ verdict, taking its case to the Court of Appeal, which upheld the initial decision. This led Protech to take its case to the Court of Cassation, which again upheld the earlier verdict.

Sources at Aptec have confirmed that the amount owed has now been paid by Protech Contracting.
