Microsoft facing 'Vista Capable' lawsuit

Microsoft is facing a class action lawsuit, which claims that it mislead PC buyers with its ‘Windows Vista Capable' campaign. The lawsuit, which was approved to proceed to trial by a judge in Seattle on Tuesday, claims that Microsoft and PC vendors badged Windows XP PCs as being suitable to upgrade to Windows Vista, when not all machines were capable of running all of the high-end features of Vista Premium.

The ‘Windows Vista Capable' campaign ran up to the launch of Vista in January, and was intended to show PC buyers if a Windows XP model would be suitable for upgrade to Windows Vista.

The lawsuit alleges that the campaign constituted deceptive and misleading marketing, as some PC models were only capable of running Windows Vista Home Basic, a stripped down version of the O/S that does not include the Aero interface, Flip 3D navigation tools or Media PC functions.

Microsoft's Windows Vista website distinguishes between Windows Vista Capable, and Vista Premium Ready and the specifications required for each.

The case is due to go to trial in October.
